Terms of Service

Effective 2020-07-14 · Last updated 2026-02-17

These terms are the agreement between JLR Logistics LLC (“RealHauler”, “we”) and the business tendering freight (“you”). A rate confirmation, contract lane schedule, dedicated capacity agreement or managed transportation agreement signed by both sides is part of the agreement and takes precedence where it differs. By signing a rate confirmation or tendering a load you accept these terms. Carriers hauling for us are governed by the carrier agreement, not these terms.

1. Services and capacity

We provide the services described on this site: truckload, LTL and partials, drayage, flatbed and oversize, expedited, cross-dock and storage, and managed transportation. A load moves either under our motor carrier authority on equipment we operate, or under our property broker authority on a carrier we have selected and vetted; the rate confirmation states which. On brokered loads we arrange transportation and remain responsible to you for the service and the paper described on this site, and the carrier is responsible for the transportation and cargo as the law provides.

2. Quotes and rate confirmations

Quotes are based on the information you give us: origin, destination, equipment, weight, dimensions, commodity, dates and accessorial needs. A rate confirmation is the price for that load. If the freight differs materially from what was quoted (weight, dimensions, commodity, hazmat, appointment requirements, site conditions), the published rates apply to the difference and the dispatcher will tell you before the truck moves where practical. Published lane and per-mile rates are linehaul; the fuel surcharge from the published table and accessorials from the published list are added as they apply.

3. Tender, cancellation and detention

A load is booked when the rate confirmation is signed. Cancellation after a truck has been dispatched is charged the truck-ordered-not-used rate on the price list. Two hours of free time apply at each pickup and delivery; detention, layover, redelivery and storage in transit are charged at the published rates when they occur and are documented on the POD or the dispatcher's log.

4. Your responsibilities

You will describe the freight accurately, including hazardous materials with the proper shipping name, class and emergency contact, and provide a bill of lading that matches; load, count, secure (unless driver load or securement is ordered) and seal the freight; provide a safe and legal place to load and unload; and obtain any consents needed for us to share delivery information with the consignee. You are responsible for freight charges whether or not the bill of lading is marked prepaid or collect, unless a written arrangement says otherwise, and for the accuracy of any declared value.

5. Fees and payment

Invoices are issued within 48 hours of the POD, payable net 30 on approved credit by ACH or check; weekly consolidated invoices for contract and managed shippers. Until credit is approved, payment by card or ACH is due before pickup. Card payments carry a 3% processing fee. Balances more than 30 days past due accrue interest at 1.5% per month or the maximum the law allows, whichever is less, and we may suspend service after ten days' written notice. You pay our reasonable costs of collection. Fees exclude taxes, which are added where they apply. Freight charges may not be offset against claims.

6. Contract lanes, dedicated capacity and managed transportation

Contract lane rates are locked for the term in the lane schedule against your weekly volume commitment; shortfalls are trued up quarterly at the published spot rate for the difference, and surpluses move at the contract rate when capacity allows. Dedicated capacity is billed at the day rates on the price list for the schedule in the agreement, with 30 days' notice to end it. Managed transportation fees are the published percentage of managed spend with the monthly minimum, invoiced monthly, with 60 days' notice to end it; on ending, your routing guide, carrier roster and data are exported to you.

7. Cargo liability and claims

On loads moving under our carrier authority, our liability for loss or damage is governed by the Carmack Amendment, 49 U.S.C. § 14706, and limited to the released value stated on the bill of lading or, where none is stated, $100,000 per shipment, unless you declare a higher value in writing before pickup and pay for the additional cargo coverage we arrange. On brokered loads the carrier is liable as the law provides, and we pursue the carrier's cargo policy and our contingent cargo policy on your behalf. Claims must be filed in writing within nine months of delivery (or of the date delivery should have occurred), with the delivery receipt, photos and the invoice value, and are handled under 49 CFR Part 370: acknowledged within 30 days, resolved or declined in writing within 120 days, with our service commitment being one business day and 60 days. Suit must be brought within two years and one day of a written declination. We are not liable for loss or damage caused by an act of God, the public enemy, the act or default of the shipper, public authority, or the inherent vice of the goods, nor for consequential damages, lost profits or market loss.

8. Service commitments

The service commitments on the how it works page are measured monthly, and the credits stated there are your sole remedy for the miss. Transit times are estimates; delays caused by the shipper, consignee, weather, road closures, port, rail or terminal operations, or public authority are excluded and reported in the scorecard.

9. Insurance

We maintain the insurance described on the compliance page and issue certificates on request. Cargo coverage above the limits there is arranged per shipment at cost when you declare a higher value before pickup.

10. Confidentiality and data

Each side keeps the other's rates, volumes, lanes, customer and carrier information confidential and uses them only for the agreement, for three years after it ends. We process shipment and contact data as described on the compliance page and in our privacy policy, and may use aggregated, de-identified operational data to improve our service.

11. Indemnity and liability

You will defend and indemnify us against third-party claims arising from the freight you tender, including undeclared or misdeclared hazardous materials, improper loading or securement you performed, and conditions at sites you control. We will defend and indemnify you against third-party claims for bodily injury or property damage caused by our negligence in operating our equipment. Except for cargo liability under section 7, each side's total liability under the agreement is limited to the freight charges on the load giving rise to the claim, and neither side is liable for indirect, consequential, special or lost-profit damages.

12. Termination

Either side may terminate for material breach not cured within 30 days of written notice. Contract lanes, dedicated capacity and managed transportation end on the notice in section 6. Loads in progress are completed and invoiced; storage is returned or released on payment of charges due.

13. General

Texas law governs this agreement, and federal law where it applies to interstate transportation; the state and federal courts in Fort Bend County, Texas have jurisdiction. Neither side may assign the agreement without consent, except to a successor in a merger or sale. Notices go to the email on the rate confirmation and to logistics@realhauler.com. If a term is unenforceable, the rest stands. We may update these terms with 30 days' notice on this page and by email to shipper contacts; loads tendered after the date are under the new terms.
